Terms of Service

By using the TroveReader application ("Service"), you ("User") are agreeing to be bound by the following terms and conditions ("Terms of Service").

1. Account Terms

  • You must be a human. Accounts registered by "bots" or other automated methods are not permitted.
  • Our service is intended for personal, non-commercial use only.
  • You are responsible for maintaining the security of your account and password. TroveReader cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

2. Content, functionalities and features

  • You are responsible for all content you upload or process through the Service ("Content").
  • We do not pre-screen Content, but we have the right (but not the obligation) in our sole discretion to refuse or remove any Content that is available via the Service.
  • You agree not to upload any Content that infringes on any copyright or is otherwise illegal.
  • TroveReader functionalities and features may differ between devices. You acknowledge that the use of the Service may require third party software that is subject to third party licenses.
  • TroveReader's name, logo, and the design of our service are our exclusive property.
  • Content accessed through our service is subject to the original creators' copyright. Users are responsible for ensuring their use of Content complies with applicable copyright laws. You may need to contact the original creator of Content you use directly to obtain proper permissions and licenses. Failure to do so may result in copyright infringement.
  • We cooperate in removing infringing or unlicensed items once an authorized representative of the rights owner properly reports them to us, in accordance with the procedure below. TroveReader will process and investigate notices of alleged infringement and will take appropriate actions under applicable intellectual property laws with respect to any alleged or actual infringement. A notification of claimed copyright infringement should be emailed to support@trovereader.com (Subject line: "Takedown Request"). To be effective, the notification must be in writing and contain the following information: (1) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest; (2) a description of the copyrighted work or other intellectual property that you claim has been infringed; (3) a description of where the material that you claim is infringing is located on the site or Service, with enough detail that we may find it on the Service; (4) your address, telephone number, and email address; (5) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law; (6) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner‘s behalf. Be aware that there can be substantial penalties for false claims.

3. Disclaimer of Warranties

The Service is provided "as is". TroveReader and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.

4.1. Third Party Websites and Content

The Service contains (or you may encounter through your use of the Service) links to other web sites operated by third parties ("Third Party Sites") as well as articles, photographs, text, graphics, pictures, designs, sound, video, information, and other content or items belonging to or originating from third parties (the "Third Party Content"). Such Third Party Sites and Third Party Content are not investigated, monitored or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third Party Sites accessed through the Service or any Third Party Content posted on, available through the Service, including the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies of or contained in the Third Party Sites or the Third Party Content. YOU AGREE THAT WE ARE ONLY ACTING AS A PASSIVE CONDUIT FOR THE VIEWING OF CONTENT. YOU UNDERSTAND AND AGREE THAT YOU MAY BE EXPOSED TO CONTENT THAT IS INACCURATE, OBJECTIONABLE, INAPPROPRIATE FOR CHILDREN, OR OTHERWISE UNSUITED TO YOUR PURPOSE, AND YOU AGREE THAT TROVEREADER SHALL NOT BE LIABLE FOR ANY DAMAGES YOU ALLEGE TO INCUR AS A RESULT OF ANY CONTENT EXPERIEINCED ON THE SERIVCE. Inclusion of, linking to or permitting the use of any Third Party Site or any Third Party Content does not imply approval or endorsement thereof by TroveReader. If you decide access Third Party Sites or to access or use any Third Party Content, you do so at your own risk and you should be aware that our terms and policies (including our privacy policy) no longer govern your use of such Third Party Sites. You should review the applicable terms and policies, including privacy and data gathering practices, of any site to which you navigate from the Service or relating to any applications you use or install from that site. TroveReader is not responsible for cookies, web beacons, clear gifs, or other code you or any third parties place on your computer or device in any way, including any association of Service content with such code. For example, if you access a Third Party Site through a link on the Service, your browser or other cookies on your computer may cause a referrer header to be sent to that site indicating some of your browsing history or the URL from which your visit originated. TroveReader shall have no liability to you in connection with any such transmission, whether or not that transmission contains information associated with or originating from TroveReader.

4.2. Third Party Services

From time to time, you may enable various online services to be directly integrated into your TroveReader experience. By directly integrating these services into TroveReader functionality, we may make your online experiences richer, and more personalized. To take advantage of these features, you may be asked to register for or log into the services on the Services of their respective providers. If you enable third party services within the TroveReader functionality, you are allowing us to pass your log-in information to these service providers for this purpose. For more information about the implications of activating these third party services and TroveReader's use, storage and disclosure of information related to you and your use of such services within TroveReader, please see our Privacy Policy at https://trovereader.com/privacy-policy. However, please remember that the manner in which third party services use, store and disclose your information is governed solely by the policies of such third parties, and TroveReader shall have no liability or responsibility for the privacy practices or other actions of any third party site or service that may be enabled within your TroveReader Service. By posting or viewing YouTube content on the Service, you agree to be bound by the YouTube Terms of Service (link). In addition, TroveReader is not responsible for the accuracy, availability or reliability of any information, content, goods, data, opinions, advice or statements made available in connection with third party services. As such, TroveReader is not liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such third party service. TroveReader may enable these features merely as a convenience and the inclusion of such features does not imply an endorsement or recommendation.

5. Limitation of Liability, Indemnity and Release

In no event will TroveReader, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for any special, incidental or consequential damages. You agree to defend, indemnify and hold harmless TroveReader and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, injury (including death), costs or debt, and expenses (including but not limited to attorney's fees) arising from or relating to: (i) your use of and access to the Service, including any data or content transmitted or received by you; (ii) your violation of any term or condition of these Terms, including without limitation your breach of any of the representations and warranties above; (iii) your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights; (iv) your violation of any applicable law, rule or regulation; (v) your User Content or any that is submitted via your account; or (vi) any other party's access and use of the Service with your unique username, password or other appropriate security code. For the avoidance of doubt, your indemnity obligations include, without limitation, claims against TroveReader that any of your User Content infringes a third party's Intellectual Property Rights.

6.1 Billing Cycle

The membership fee for the TroveReader premium Service and any other charges you may incur in connection with your use of the Service, such as taxes and possible transaction fees, will be charged to your Payment Method as shown via the "Account Management" page. The length of your billing cycle will depend on the type of subscription that you choose when you signed up for the Service. In some cases your payment date may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid membership began on a day not contained in a given month. This date may be seen via the "Account Management" page. We may authorize your Payment Method in anticipation of membership or Service-related charges through various methods, including authorizing it for up to approximately one month of Service as soon as you register for premium. If you signed up for TroveReader using your account with a third party as a Payment Method, you can find the billing information about your TroveReader membership by visiting your account with the applicable third party.

6.2. Payment Methods

To use the TroveReader premium Service you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the Service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method Service provider for details.

6.3 Updating your Payment Methods

Updating your Payment Methods. You can update your Payment Methods by going to the "Account" page. We may also update your Payment Methods using information provided by the payment Service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).

6.4. Cancellation

You can cancel your TroveReader premium membership at any time, and you will continue to have access to the premium Service through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial membership periods. To cancel, go to the "Account Management" page and follow the instructions for cancellation. If you cancel your membership, you will lose access to all premium benefits at the end of your current billing period, but you will continue to be able to use the free-tier product. To see when your account will close, click "Billing details" on the "Account" page. If you signed up for TroveReader using your account with a third party as a Payment Method and wish to cancel your premium membership, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the TroveReader Service through that third party.

7. Class Action Waiver

WHERE PERMITTED UNDER THE APPLICABLE LAW, YOU AND TROVEREADER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, where permitted under the applicable law, unless both you and TroveReader agree otherwise, the court may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding.

8. Survival.

If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

9. Governing Law.

These Terms of Use shall be governed by and construed in accordance with the laws of Germany.

10. Downtime

The Service may be temporarily unavailable from time to time for maintenance or other reasons. TroveReader shall have no responsibility for any interruption, delay in operation or transmission, theft or destruction of, unauthorized access to, or alteration of User Content, or any other content made available via the Service. Under no circumstances will TroveReader be responsible for any personal injury or death resulting from the use of the Service, any User Content or third party content, or any use of products or services provided by Users.

11. Changes

We reserve the right, at our sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes.
